<p>In this recording Cath reflects on the importance of ethics and professional conduct in the legal profession. She acknowledges that these topics may not initially seem exciting, but they are crucial to being not just competent lawyers but also <b>good </b>lawyers!</p>

<p>Throughout the course, we have explored various topics, including the rapid technological advancements in the practice of law. Despite these changes, the core tasks of lawyers have remained the same throughout history - it's just how we do them that has changed. </p>

<p>In terms of exam preparation, it is important to focus on the Course Learning Outcomes (CLOs) to understand what will be assessed. </p>

<p>Cath walks through the content available that will help you to practice short answer questions, analyze past exam questions, and utilize the provided resources to prepare effectively. Time management, judicious use of content, and understanding what is being assessed will be key to your success. </p>

<p>In this discussion, Carly Marcs provides an overview of the background to <a href="https://jade.io/article/656686" target="_blank"><i>Faruk Orman v The Queen</i> [2019] VSCA 163; 59 VR 511</a>. This was a high profile case, the first successful appeal by a person wrongfully convicted based on evidence collected by Nicola Gobbo (Lawyer X) a barrister who was providing information to Victoria Police.</p>

Prosecutions in summary jurisdictions are often conducted by police officers who may not be legal practitioners. This raises ethical questions regarding their adherence to professional conduct rules, as clearly 'non lawyers' are not covered by the Australian Solicitors Conduct Rules or the Uniform Barristers Rules.</p>

<p>Cath emphasizes the importance of independence and impartiality for prosecutors, whose client is the State. They are tasked with uncovering the truth and presenting it to the court, rather than simply seeking convictions - something addressed in both the ASCR and the Uniform Barrister's rules. </p>

<p>Prosecutors also have a duty of disclosure, requiring them to provide all relevant material to the defense. Failure to do so can result in miscarriages of justice.  We look at two key cases where the prosecution failed in these duties, <b><i>Mallard v The Queen</i></b> [2005] HCA 68; 224 CLR 125 and <b><i>JB - Application for inquiry into conviction pursuant to s 78 of the Crimes (Appeal &amp; Review) Act 2001 </i></b>[2014] NSWSC 1714</p>

<p>The discussion raises interesting ethical questions around the balance between seeking justice and convicting, as well as the implications of prosecutors being part of an indivisible entity representing the state. How can prosecutors maintain independence from the police while still accessing all the necessary information? This raises questions about whether advocate's immunity truly serves the interests of justice or merely protects lawyers at the expense of their clients.</p>

<p>The concept of judicial immunity will also be examined. Judges are generally immune from being sued for actions taken in their judicial capacity. While disciplinary proceedings are not criminal in nature, the suspension or removal of a practicing certificate can effectively prevent a practitioner from practicing law, serving as a punishment.</p>

<p>The discussion then turns to the ways that legal publishers are utilizing AI, particularly big data pattern recognition, to improve search efficiency. This advancement saves valuable time previously spent searching for key information in cases, allowing for more focused processing and understanding.</p>

<p>The discussion then shifts to the field of AI and the law, which has been under study for several decades. Richard Suskin's idea of pragmatic and purist approaches in AI and the law is introduced. The closer an AI system is to being hand-coded with human decisions and inputs, the more basic it will be and the more likely it is to move towards general AI. Currently, most AI systems in the legal profession are at the hand-coded statistical reasoning stage, though clearly ChatGPT is shaking things up!</p>

<p>The limitations of representing legal knowledge in AI systems are also explored. While early computational modeling of law conceptualizes it as a decision tree, there are challenges in replicating more theoretical legal knowledge. The importance of identifying the unique and specialized aspects of the legal profession, rather than solely manipulating data or reproducing previous steps, is emphasized.</p>

<p>Ethical considerations for AI take center stage, with the recognition that AI is efficient at collecting and analyzing large amounts of data. However, it is important to be aware of potential misinterpretation or differing views on certain data points. The ethical implications of using AI in the legal profession and society are crucial to address.</p>

<p>The episode concludes by highlighting the evolving role of lawyers beyond utilizing AI tools. The focus is on delivering ethical and professional services and outcomes. AI may be disruptiive, but it also removes mundane tasks, allowing young lawyers to focus on more engaging work. The future of AI is uncertain, potentially reaching stages of effective computing, emotional detection, and self-awareness. The possibility of a new field of law called machine rights law is considered, reaffirming the significant role AI will play in future professions, including legal practice.</p>
